Terms of Service

1. Scope and provider

These terms govern the use of the Herukan Discord bot, the dashboard at app.herukan.com and the associated website. The provider is Kilian Hauber, Am Rosengarten 18B, 79183 Waldkirch, Germany (“we”). Use requires a Discord account; Discord’s own terms apply in addition and are outside our control.

2. The service

Herukan provides features for Discord servers including welcome messages, moderation, AutoMod, leveling, tickets, giveaways, reaction roles, server statistics, custom commands and YouTube, Twitch, Kick and Bluesky notifications.

A basic scope is free of charge. Beyond that we offer the paid tiers Plus and Ultimate, which unlock additional features and higher limits. The features and limits of each tier are described in the dashboard and in the documentation.

3. Conclusion of contract

For free use, a contract with us is concluded when you invite the bot to a Discord server or sign in to the dashboard.

Paid tiers are purchased exclusively through Discord’s subscription system (“Premium Apps”). The purchase contract for the subscription is concluded between you and Discord; Discord is the seller and receives the payment. We provide the unlocked features and only learn from Discord which tier is active for which server.

Everything relating to the purchase itself — prices, billing, payment methods, invoices, cancellation, withdrawal and refunds — is therefore governed by Discord’s terms. These terms govern the use of the service.

4. Prices and payment

Current prices are shown to you in Discord before purchase and are authoritative. Billing and collection are handled exclusively by Discord under its terms, including the treatment of applicable taxes. We receive no payment data from you.

5. Term and cancellation

Subscriptions run for one month and renew automatically until cancelled. You cancel in your Discord account’s subscription settings in accordance with Discord’s terms. Once a subscription ends, the paid features are no longer available; the free scope remains usable. Free use can be ended at any time by removing the bot from your server. The right to terminate for cause remains unaffected for both parties.

6. Withdrawal and refunds

Because the purchase contract for paid tiers is concluded with Discord (see section 3), any right of withdrawal and any refunds are governed by Discord’s terms and must be claimed there. We can neither accept nor refund payments.

7. Your obligations

When using Herukan you agree to:

  • comply with Discord’s terms of service and policies,
  • meet Discord’s minimum age requirement (13 years in Germany; minors require the consent of a legal guardian),
  • not use the service for unlawful content, harassment, spam or mass messaging,
  • not attempt to overload or circumvent the service or to access other servers’ data without authorisation,
  • as a server owner, inform your members about the use of the bot where you are required to do so.

We may suspend access in the event of serious or repeated violations. Any claim to a refund of amounts already paid to Discord must likewise be directed to Discord.

8. Availability

We aim for continuous operation but do not owe any specific availability. The service depends entirely on Discord’s availability and APIs; outages, changes or restrictions on Discord’s side are beyond our control. We announce maintenance where possible.

9. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded.

Automated features such as AutoMod act according to the rules you configure. We are not responsible for the consequences of your configuration, such as deleted messages or bans you have set up.

10. Changes to these terms

We may change these terms where necessary to reflect changes in the law, case law or the service. If you have an active paid tier we will notify you at least 30 days before the change takes effect. If you do not object before it takes effect, the change is deemed accepted; if you object, the usage agreement ends when the change takes effect.

11. Data protection

Details on the data we process are set out in our privacy policy.

12. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in the EU, mandatory consumer protection provisions of your country of residence remain unaffected. If any provision is invalid, the remaining provisions remain in force.
